HAUNTED TRAIL WAIVER OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT

Event Name:  Screamin’ Holler Haunted Trail
Location: Black Rose Farm, 6815 E Blue Creek Rd, McEwen, TN 37101

PLEASE READ THIS DOCUMENT CAREFULLY. BY SIGNING THIS WAIVER, YOU ARE GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

I, the undersigned participant, hereby acknowledge and agree to the following terms and conditions as a prerequisite to participating in the Screamin’ Holler Haunted Trail:

Assumption of Risk

I understand that participation in the haunted trail experience involves inherent risks, including but not limited to:

• Fog Effects: The use of artificial fog and smoke may impair visibility, affect breathing, and create disorientation.

• Strobe Effects: The use of strobe lighting may cause dizziness, disorientation, or trigger seizures in individuals with photosensitive epilepsy.

• Uneven Terrain: The trail may contain uneven surfaces, rocks, roots, mud, and other natural obstacles that could cause slips, trips, or falls.

• Other Risks: The experience may also involve sudden loud noises, scares, actors in costume, and other unsettling or frightening elements that could cause emotional distress or physical reactions.
  I voluntarily assume all risks associated with participation in this haunted trail, including but not limited to injury, illness, emotional distress, or property damage.

Medical Considerations

I certify that I am physically fit and have no known medical conditions that would prevent me from safely participating in the event. If I am sensitive to strobe lights, fog, or other potential hazards, I agree not to participate or to take the necessary precautions.

Release of Liability

In consideration of being permitted to participate in the Screamin’ Holler Haunted Trail, I, for myself, my heirs, executors, and assigns, hereby release and hold harmless Black Rose Farm, LLC, its affiliates, employees, contractors, volunteers, and any associated sponsors, from any and all liability, claims, or demands arising out of or related to any injuries, damage, or loss that may occur from my participation in this event, including, but not limited to:

• Injury or death caused by slips, trips, falls, or other physical incidents.

• Medical emergencies resulting from pre-existing conditions, including asthma, epilepsy, or heart conditions.

• Emotional or psychological distress resulting from fear, anxiety, or surprise during the haunted trail experience.

Indemnification

I agree to indemnify and hold harmless Black Rose Farm, LLC and its affiliates for any claims, damages, costs, or expenses (including attorneys’ fees) incurred due to my participation or conduct during the haunted trail.

Acknowledgement of Rules and Regulations

I agree to follow all posted rules and instructions provided by event staff. I understand that failure to comply with these rules may result in my removal from the event without refund.
