Participant Waiver & Release of Liability
Black Rose Farm, LLC – Screamin’ Holler Haunted Trail, Corn Maze, Pumpkin Patch, and Related Activities
By purchasing a ticket and/or participating in any activities at Black Rose Farm, LLC (“the Farm”), you acknowledge and agree to the following terms:
I understand that activities at the Farm, including but not limited to the haunted trail, corn maze, pumpkin patch, hayrides, winery events, and other agritourism activities, involve inherent risks. These may include uneven terrain, darkness, strobe lights, loud noises, live actors, animals, natural hazards, slips, trips, falls, weather-related conditions, and other unpredictable risks. I voluntarily assume full responsibility for myself (and any minor children under my supervision) for any risks of injury, property damage, or other loss arising from participation.
I certify that I (and any minors under my supervision):
In consideration of being allowed to enter and participate, I hereby release, waive, discharge, and agree to hold harmless Black Rose Farm, LLC, its owners, employees, volunteers, contractors, and affiliates from any and all claims, demands, causes of action, or liability for injury, illness, death, property damage, or other losses that may arise from participation, whether caused by negligence or otherwise, to the fullest extent permitted by law.
Pursuant to Tennessee Code Annotated § 43-39-10, WARNING:
Under Tennessee law, there is no liability for an injury to or death of a participant in an agritourism activity conducted at this agritourism location if such injury or death results from the inherent risks of the agritourism activity. Inherent risks of agritourism activities include, among others, risks of injury inherent to land, equipment, and animals, as well as the potential for negligent acts of participants and other visitors. You are assuming the risk of participating in this agritourism activity.
I grant permission for Black Rose Farm, LLC to use photographs, video, or audio recordings of me (and any minors with me) taken during participation for promotional purposes without compensation.
This agreement shall be binding upon me, my heirs, executors, administrators, and assigns. If any portion is held invalid, the remainder shall continue in full force.
By checking the box at checkout and completing this purchase, I acknowledge that I have read, understood, and voluntarily agree to this Waiver & Release.
